Welcome to MitGear. By accessing this website and purchasing products from us (Remediation Training & Consulting, LLC dba MitGear), you agree to the following Terms & Conditions.
1. Acceptance of Terms
By using this website or placing an order, you agree to be bound by these Terms & Conditions, as well as our Shipping Policy and Returns & Refunds Policy.
If you do not agree, please do not use this site.
2. Product Information & Availability
We strive to ensure product descriptions, specifications, pricing, and availability are accurate. However, errors may occur.
We reserve the right to:
- Correct errors or omissions
- Change product specifications without notice
- Limit quantities
- Cancel orders affected by pricing or listing errors
3. Pricing & Payment
All prices are listed in U.S. dollars and apply to the 48 contiguous United States unless otherwise stated.
Payment is due in full at the time of purchase. We reserve the right to cancel or refuse any order at our discretion.
4. Order Acceptance & Cancellation
Submission of an order does not constitute acceptance. Orders are accepted only when processed and shipped.
We reserve the right to cancel orders due to:
- Suspected fraud
- Pricing errors
- Inventory shortages
- Shipping limitations
- Violation of these Terms
If payment has been captured, a refund will be issued.
5. Shipping & Delivery
Shipping terms are governed by our Shipping Policy.
Delivery dates are estimates only and are not guaranteed. MIT Gear is not responsible for delays caused by carriers, weather, labor issues, or other circumstances beyond our control.
6. Risk of Loss (FOB Origin)
All shipments are FOB Origin.
Ownership and risk of loss transfer to the customer when the order leaves our warehouse or supplier facility.
We will assist with carrier claims but are not responsible for loss or damage in transit.
7. Inspection & Acceptance of Goods
Customers must inspect shipments upon delivery and report any damage, shortages, or errors within 24 hours.
Failure to report issues within this timeframe may result in denial of claims.
8. Returns & Refunds
Returns are governed by our Returns & Refunds Policy. Products must meet eligibility requirements to be accepted for return.
9. Warranty Disclaimer
Products may be covered by manufacturer warranties only.
MIT Gear makes no additional warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, except as required by law.
10. Limitation of Liability
To the maximum extent permitted by law, MIT Gear shall not be liable for:
- Indirect or consequential damages
- Lost profits or business interruption
- Delays in delivery
- Improper installation or use
- Jobsite losses
Our total liability shall not exceed the purchase price of the product.
Fraud & Chargeback Prevention Provisions
11. Fraud Prevention & Order Verification
We reserve the right to verify all orders prior to shipment. This may include:
- Address verification
- Identity confirmation
- Phone or email verification
- Requests for additional documentation
Orders suspected of fraud may be delayed, canceled, or refunded.
12. Unauthorized Transactions
Customers are responsible for securing their payment credentials.
MIT Gear is not liable for unauthorized transactions made using your payment method.
13. Chargebacks & Payment Disputes
By completing a purchase, you agree to contact MIT Gear to resolve any issues before initiating a chargeback or payment dispute.
Initiating a chargeback without first contacting us may be considered a breach of these Terms.
We reserve the right to:
- Contest illegitimate chargebacks
- Provide documentation to the issuing bank
- Recover fees, losses, and associated costs
- Suspend or ban accounts involved in fraudulent disputes
14. Refused Shipments
Orders refused at delivery for reasons other than severe damage will be treated as customer returns and subject to all applicable shipping charges and restocking fees.
15. Limitation of Use
Products sold are intended for professional or contractor use. Customers are responsible for ensuring proper installation, operation, and compliance with applicable laws and safety standards.
16. Account Termination
We reserve the right to refuse service, cancel orders, or terminate accounts at our discretion, including for suspected fraud or abuse.
17. Intellectual Property
All content on this site, including text, graphics, logos, and images, is the property of MIT Gear and may not be used without permission.
18. Governing Law
These Terms shall be governed by the laws of the State of Utah, without regard to conflict of law principles.
19. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the site constitutes acceptance of the updated Terms.
20. Sales Tax
Sales tax is calculated at checkout based on the shipping destination and applicable state and local laws.
We collects sales tax in states where we are required to do so by law. If no sales tax is charged at checkout, the customer may still be responsible for use tax according to their local regulations.
Tax rates and rules vary by jurisdiction and may change without notice.
21. Marketplace and Government Requirements
We comply with all applicable federal, state, and local tax laws, including economic nexus requirements. We do not determine tax obligations beyond those required for collection at the point of sale.
Customers are responsible for any additional taxes, duties, or fees imposed by their jurisdiction.
